General Conditions of Sale

The present general conditions of sale have as their object the discipline of the purchase of products and services, carried out remotely and made available, via the internet, by www.florencemoon.it in compliance with Italian law as per Legislative Decree 206/2005 and subsequent amendments.

The seller of the products and owner of the FlorenceMoon.it website is Guelfi srl Via dei Coronari, 00186 Rome PI 15540901004, regularly authorised to sell retail online.

The consumer who accesses the Site to make his purchases is required, before sending the order, to read carefully these General Conditions that have been made available on the Site and will be available at all times by the customer through the link contained in the email confirmation of each order to allow him to reproduce and store.  

How to make a purchase on www.florencemoon.it

For the purchase of retail products, the Customer must fill in and send the order form in electronic format, following the instructions contained in the Site. The Customer will have to add the Product to the "Shopping Cart", then he/she will have to insert the shipping and invoicing data, then he/she will have to select the desired payment method and confirm the order only after having read the General Conditions and the Privacy Policy and confirmed their acceptance.

By sending the order from the Site, which has the value of a contractual proposal, the Customer acknowledges and declares to have read all the information provided during the purchase process and to fully accept these General Conditions and payment transcript.

The contract stipulated between Florencemoon and the Customer will be considered concluded with the acceptance of the order by Florencemoon. This acceptance will be communicated to the Customer by means of an email confirming the order itself, containing a reference to these General Conditions, the order number, the shipping and invoicing details, the list of Products ordered with their essential characteristics and the total price, including any delivery costs.

Once the order has been received, Florencemoon will check stock availability in order to process the order. If one or more Products are not available, the Customer Service of Florencemoon will promptly send an email to the Customer who, within the next 12 hours, will have the right to reply to confirm the shipment of any further Products available or cancel it. If there is no reply within this period, the order will be considered confirmed and the Products available will be sent. The amount of the missing Products will be immediately reversed according to the payment method chosen.

3. Information on Products

Information and characteristics relating to the Products are available on the Site www.florencemoon.it.

The visual representation of the Products on the Site, where available, normally corresponds to the photographic image accompanying the description card. It is understood that the image of the Products has the sole purpose of presenting them for sale and may not be perfectly representative of their characteristics and quality but may differ in color and size.

 

Prices and shipping

All sales prices of the products displayed and indicated on the site www.florencemoon.it include VAT and any other tax for the E.C. countries. For non-EC countries, there may be customs charges.

The products purchased on the site will be delivered to the address indicated by the customer during the purchase process in the field "Shipping Information".

All purchases will be delivered by express courier from Monday to Friday, excluding holidays and national holidays. Florencemoon is not responsible for delays that cannot be foreseen or attributed to it.

Once the Products have been dispatched, the Customer will receive a confirmation email which will include a link to refer to for tracking the shipment.

In any case, except in cases of force majeure or unforeseeable circumstances, the products ordered will be delivered within a period of 14 working days from the day on which the customer has received the order confirmation email.

Delivery services active in Italy and abroad:

Express Courier

The service provides a first attempt at delivery at the address indicated at the time of order. After each step will be left a notice. If the attempt is not successful, will be sent a notice via email inviting you to contact by phone the customer service www.florencemoon.it, which will arrange a new delivery attempt. If not traceable or absent, the goods will return to the warehouse.

 

Payment method

The Customer can pay the price of the Products and the relative delivery costs by Credit Card, PayPal, Cash on Delivery or Bank Transfer:

Credit Card 

Payment for the Products purchased on the Website can be made by credit card directly through the Website.  Florencemoon accepts credit cards of the VISA, Mastercard and Maestro circuits. The credit cards accepted are, in any case, indicated in the footer of each page of the website. The total amount owed by the user to Florencemoon will be debited at the time of transmission of the order.

Florencemoon uses the secure payment service that uses the SSL security protocol. Confidential credit card details (card number, holder, expiry date, security code) are encrypted and transmitted to the payment manager. 

PayPal

PayPal, a company of the eBay group, is a fast and secure payment system. Once you have selected this method of payment and then clicked on "Confirm Order" will open in overlay a window where you can choose between two options:

- Make the payment with your personal Paypal account;

or

- Pay with any credit/prepaid card (Visa, Visa Electron, Postepay, PayPal Card, Mastercard).

The system communicates directly with PayPal in total safety so Florencemoon is never aware of the data relating to your method of payment. The amount will be charged directly to your credit card (Visa, Visa Electron, Postepay, Mastercard) or prepaid card (PostePay) that you have chosen or associated with your PayPal account. For each transaction you will receive a confirmation email from PayPal. The amount of the order will be charged to your PayPal account at the time of order acquisition. In case of cancellation, the amount will be refunded to your PayPal account or your credit/prepaid card.

Payment by PayPal or Credit Card speeds up the time of shipment of the order, because the transaction is verified instantly and your order is processed immediately.

Cash on delivery

With the cash on delivery method you can pay in cash the exact amount of 'order directly to the Courier upon delivery.

There will be an extra charge of cash on delivery on the total order

To facilitate the procedures for the delivery of products, make sure you have the exact amount verifying it in the email summary of the order, because the couriers are not obliged to have the cash needed to provide the rest.

Payment by Bank Transfer

If you choose the Bank Transfer as a method of payment, you must make the transfer at the time of the order. The bank details to make the payment you will receive them in the mail order confirmation, if you have not received the mail check in the spam box or contact customer service to verify if the email address is correct. The products will be shipped only to credit occurred. 

Your order will remain in the "Waiting" status until Florencemoon systems notify the accounting of the bank transfer. Payment by bank transfer does not guarantee the same speed as other payment methods: product shipment is delayed by 24 working hours for National Bank Transfers and by 3 to 6 working days for International Bank Transfers.

 

Billing

For each order placed on the site Florencemoon is issued an invoice / tax receipt of the material shipped. The invoice is issued at the same time as the order is processed and normally accompanies the goods in the envelope placed on the packaging. For the emission of the invoice they make faith the information furnished from the Customer during the procedure of purchase. After the issuance of the invoice, it will not be possible to make any changes to the data indicated in the same. The amounts will be reported in the invoice only in Euro


Right of withdrawal

To request return authorization, the Customer must send a request to info@Florencemoon.it within 14 days of receiving the order. The e-mail must specify the codes of the articles to be returned and the compensation desired: size change, color change, article change or refund. Once the return request has been received, FlorenceMoon.com will send the customer written confirmation.  The only expenses that the customer will have to bear are the shipping payments. The Right of Return - in addition to compliance with the terms and procedures described above - is understood to have been exercised correctly if the following conditions are also fully respected: the products must not have been used, worn, washed or damaged; the identification tag must still be attached to the products with the disposable seal that constitutes an integral part of the goods; the returned products must be handed over to the courier within ten (14) working days from the date on which you received the products. If the Right of Return is exercised following the procedures and terms indicated in this paragraph, Florencemoon will refund any sums already received for the purchase of the products. The sums will be reimbursed in the shortest time possible and, in any case, within thirty (30) days from the date on which Florencemoon became aware of the exercise of the Right of Return, we will activate the reimbursement procedures, once we have verified the correct execution of the terms and conditions indicated above. If the methods and terms for exercising your Right of Return, as specified in this paragraph, are not respected, the customer will not be entitled to a refund of the sums already paid to Florencemoon.

Exclusions of withdrawal

The right of withdrawal and 'excluded in relation to:

a) service contracts after the full performance of the service if the performance has begun with the express agreement of the consumer and the acceptance of the loss of the right of withdrawal following the full performance of the contract by the trader;

b) the provision of goods or services whose price and 'tied to fluctuations in the financial market that the trader is not' in control and that may occur during the withdrawal period;

c) the supply of goods made to measure or clearly personalized;

d) the supply of goods which are liable to deteriorate or expire rapidly;

e) the supply of sealed goods that are not suitable for return for hygienic or health protection reasons and have been opened after delivery;

f) the supply of goods which, after delivery, are, by their nature, inseparably mixed with other goods;

g) the supply of alcoholic beverages, the price of which has been agreed at the time of conclusion of the sales contract, the delivery of which can only take place after thirty days and the actual value of which depends on fluctuations in the market that cannot be controlled by the trader;

(h) contracts where the consumer has specifically requested a visit by the trader for the purpose of carrying out urgent repair or maintenance work.

If, on the occasion of such visit, the trader provides services in addition to those specifically requested by the consumer or goods other than spare parts necessary to carry out the maintenance or repairs, the right of withdrawal shall apply to such additional services or goods;

(i) the supply of sealed audio or video recordings or sealed computer software that have been opened after delivery;

(j) the supply of newspapers, periodicals and magazines with the exception of subscription contracts for the supply of such publications;

(k) contracts entered into in connection with a public auction;

l) the provision of accommodation for non-residential purposes, the transport of goods, car rental services, catering services or services relating to leisure activities if the contract provides for a specific date or period of performance;

m) the supply of digital content by means of a non-material support if the performance and 'started with the express agreement of the consumer and his acceptance of the fact that in this case would have lost the right of withdrawal.

Legal warranty of conformity

Since March 23, 2002 products enjoy 24 months of legal warranty, or warranty for lack of conformity, as per Legislative Decree February 2, 2004, n.24. The legal warranty or warranty for lack of conformity, or defects or lack of promised quality, concerns a problem that the good has presented since its origin, such as a processor that does not reach the frequency indicated by the seller. The consumer can in this case invoke the guarantee for lack of conformity valid for two years from the date of purchase provided by the new law. The legal guarantee therefore finds application in the cases in which the contract has not, strictly speaking, been respected, because it has been delivered a good different from that previewed or however in degree to carry out the agreed performances.

According to the art. 132 Cod. Cons., the legal guarantee lasts two years from the delivery of the good but must be asserted by the consumer within 60 days from the discovery of the defect.

In case of conformity defects of products sold by Florencemoon, the Customer must immediately contact Customer Service.

All products sold by Florencemoon are covered by the conventional manufacturer's warranty and by the 24-month warranty for conformity defects, pursuant to Legislative Decree 24/02.

To benefit from warranty service, the customer must keep the receipt (or invoice-receipt) that will be received in the package, attached to the product purchased. The manufacturer's conventional warranty is provided in the manner illustrated in the documentation inside the product packaging.

Limitations of liability

The information on the Products provided through the Site is constantly updated. However, it is not possible to guarantee the complete absence of errors, for which Florencemoon cannot therefore be held responsible, except in cases of fraud or serious fault.

Florencemoon reserves the right to correct errors, inaccuracies or omissions even after an order has been sent, or to modify or update information at any time without prior notice, without prejudice to the rights of the Customer under these General Conditions and the Consumer Code.

Except malice or gross negligence, any right of the Customer to damages or compensation is excluded, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and/or things, caused by the non-acceptance or evasion, even partial, of an order.

The Customer (Company) by accepting these "General Conditions", declares, under its full and exclusive responsibility, to purchase the Products offered online by Florencemoon as a final consumer in a retail sale (B2C Business to Consumer).

Consequently, any civil, criminal and/or administrative responsibility attributable to Florencemoon, arising from, descending from and/or connected to false declarations made by the Customer (Company) regarding his or her status as final consumer, as specified above, will be attributable exclusively to the latter, without prejudice to the right of Florencemoon to request compensation from the Customer (Company) for all damages suffered and incurred. 

Applicable law and jurisdiction

The sales contract between the Customer and Florencemoon is understood to be concluded in Italy and regulated by Italian Law. For the solution of disputes relating to the interpretation, execution or resolution of these General Conditions or individual purchase orders, if the Customer is a consumer according to the Consumer Code, the exclusive competent court will be the one in his or her town of residence or domicile if located in the Italian territory; in all other cases, the territorial competence is exclusively that of the Court of Rome, any other competent court being excluded.

 

Online Dispute Resolution

European consumers are hereby informed that the European Commission has set up an online platform that provides an alternative dispute resolution tool.

This tool can be used by the European consumer to resolve in a non-judicial way any dispute relating to contracts for the sale of goods and services concluded online and/or arising from them.

Consequently, if you are a consumer established in Europe, you can use this platform to resolve any dispute arising from the online contract entered into on this site.

Pursuant to article 1341 of the Italian Civil Code, the Customer declares to have read and specifically accepted these General Conditions.
